Terms of Service

1. Acceptance of Terms

By accessing or using the Nearest Cutz platform ("Platform"), including our website, mobile applications, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and Nearest Cutz LLC ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Platform Description

Nearest Cutz is a three-sided marketplace connecting customers ("Clients") with professional barbers ("Barbers") and barbershop facilities ("Facilities"). Our Platform enables:

  • Clients to discover, book, and pay for grooming services
  • Barbers to manage their schedules, services, and client relationships
  • Facilities to list their spaces and manage barber partnerships

We act as an intermediary platform and are not a party to the service agreements between Clients, Barbers, and Facilities.

3. User Accounts and Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account
  • Be at least 18 years old or have parental consent

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Booking and Cancellation Policy

Booking Confirmation

All bookings are subject to Barber availability and confirmation. You will receive a confirmation notification once your appointment is accepted.

Cancellation by Clients

  • Cancellations made 24+ hours before: Full refund
  • Cancellations made 4-24 hours before: 50% refund
  • Cancellations made less than 4 hours before: No refund
  • No-shows: No refund and may result in account restrictions

Cancellation by Barbers

If a Barber cancels, you will receive a full refund and may be offered priority rebooking. Repeated cancellations by Barbers may result in Platform restrictions.

5. Payment Terms

Payment Processing

All payments are processed securely through Stripe. By making a payment, you authorize us to charge your selected payment method for the total amount of your booking.

Revenue Distribution

Service fees are distributed as follows:

  • 60% to the Barber providing the service
  • 30% to the Facility hosting the service (if applicable)
  • 10% to Nearest Cutz as a platform fee

For mobile/freelance Barbers not operating from a Facility, the distribution is 90% to the Barber and 10% to Nearest Cutz.

Gratuities

Tips are optional and are passed directly to Barbers at 100% without any platform deduction.

6. User Conduct

All users agree NOT to:

  • Violate any applicable laws, regulations, or third-party rights
  • Post false, misleading, or defamatory content
  • Harass, threaten, or discriminate against other users
  • Circumvent Platform fees by arranging off-platform payments
  • Use the Platform for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to Platform systems
  • Interfere with the proper functioning of the Platform

7. Intellectual Property

The Nearest Cutz name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Nearest Cutz LLC. You may not use such marks without prior written permission.

By submitting content to the Platform (reviews, photos, etc.), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with our services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEAREST CUTZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Personal injury or property damage arising from services provided by Barbers
  • Actions or omissions of third-party service providers
  • Service interruptions or data loss

Our total liability shall not exceed the amount paid by you for services in the twelve (12) months preceding the claim.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.
